There are many reasons why couples choose to get a legal separation instead of a divorce. We can assist you with making the right decision that is best for your situation. Our attorneys have over 40 years of combined experience in family law and will provide you with the best representation to help with your marital concerns. We are dedicated to assisting active duty military and middle-class families throughout Virginia Beach, Norfolk, and Chesapeake, who turn to us to provide sound legal counsel.
Although Virginia doesn’t have an outright decree of separation, there are ways in which to become legally separated:
• Just live apart for a year if you have children and if you don’t have children, live apart for six months.
• Get a settlement agreement or property settlement which clearly outlines resolutions to all of the issues regarding your marriage.
• Obtain a divorce of bed and board which is a fault based decree. It must be proven that abandonment, cruelty, desertion, or reasonable expectation of bodily harm would ensue.
A separation agreement is a legal document which is signed by both spouses. It is a formal way to separate as an alternative to a divorce.
