The marital home is part of what must be settled in a divorce division of property.  There are actually several options available when it comes to dividing this asset:

  • You can sell the home and split the proceeds from the sale.

  • One of you can own the home solely.

  • One spouse can live in the home and you can continue to jointly own it with the intention to sell in the future (often a good idea if your mortgage is under water).

  • Own the home jointly and rent it.

While a divorce court can decide ownership of the home, there is one thing that the court cannot completely control: the mortgage. While the court can order either of you to be responsible for the mortgage, the court has no jurisdiction over your bank and cannot force it to take one of your names off the mortgage. When dealing with a home in a divorce, there are several choices with regard to the mortgage:

  • You can both continue to be responsible for the mortgage, perhaps planning to sell the home in the future.

  • One of you can refinance the mortgage into your own name.

  • If you are not eligible for a refinance, you can ask the bank to take one name off the mortgage, but banks are not obligated to do so
