The penalties for impaired driving in Virginia

It is illegal in Virginia to operate a motor vehicle if your blood alcohol content (BAC) is 0.08 percent or higher. Drivers may also be considered to be driving under the influence (DUI) with a BAC below 0.08 if their ability to operate the vehicle is impaired. Drivers arrested for DUI face a number of criminal penalties, including incarceration, license suspension, community service and monetary fines. The penalties for driving under the influence of drugs are the same as drunk driving.
