Texting is one of the most dangerous types of distracted driving because it involves all three types of distraction. In fact, drivers who text behind the wheel are 23 times more likely to be involved in a motor vehicle accident.

 

Given the risks, Virginia prohibits all drivers from texting behind the wheel. Under a new anti-texting law implemented in 2013, drivers are prohibited from typing and reading texts and emails using a smart phone or other hand-held communications device while operating a moving motor vehicle. Therefore, if the driver who caused your injuries was texting at the time of the crash, you have a strong negligence case.
