Child Support

A child support case begins by your divorce attorneys filing a petition seeking child support. If the court determines that child support is necessary, it is set according to state child support guidelines, which determine monthly payments based on the number of children and the parents’ income. The court considers a number of factors, including:

  • Support paid for other children or past spouses

  • Custody, including the cost of visitation travel

  • Whether a parent is voluntarily unemployed or underemployed

  • The cost of child care needed for the custodial parent to go to school

  • Marital debts that were for the benefit of the child

  • Life insurance, education costs or other payments for the benefit of the child

  • Capital gains from the sale of the marital home

Child support is also affected by custody arrangements. The W. Ware Morrison Law Group helps you obtain a reasonable child support settlement or judgment as part of your divorce process.

In addition to support set according to the state guidelines or the factors listed above, the court may also order a parent to pay:

  • The child’s special needs

  • Independent resources of the child

  • The standard of living for the child during the marriage

  • The earning abilities, financial resources, debts and special needs of the parents

  • The distribution of income-earning marital property

  • The tax consequences to the parties

  • Written agreements about child support between the parents

  • Health insurance costs for the child

  • Unpaid medical expenses for the child

  • Life insurance naming the child as beneficiary

In Virginia, child support ends when the child reaches age 19 or graduates from high school. For information about modifying child support payments, talk with your attorney at the W. Ware Morrison Law Group, where we handle all of your family law issues.
