Virginia courts determine child custody by considering what is in the best interests of the children. It makes no difference whether the parents are married or unmarried. In making that determination, the courts consider factors such as:

There are two types of custody in Virginia: legal and physical. Physical custody describes where the child’s main residence is. The parents without physical custody are given visitation rights so they can still be an important part of their children’s lives.
